Dumping Grass, Branches and Soil Is Still Fly-Tipping - Even If It Is "Natural"

There is a stubborn myth that garden waste does not really count - that a few bags of grass cuttings tipped over a fence, or a trailer of branches left at the edge of a wood, will just rot down and do no harm. In Scotland, that is illegal fly-tipping, and SEPA is explicit about it. Green waste dumped on land without permission is treated the same as any other fly-tipped rubbish.

Why "it is natural" is no defence

SEPA specifically warns people not to dump green waste in forests, fields or rural areas in the belief it will decompose harmlessly. It does not work that way. Dumped grass and cuttings smother native plants, spread invasive species and garden escapees into the countryside, and can choke watercourses. Soil and turf can carry weeds and contaminants. Legally, depositing any controlled waste - and garden waste is controlled waste - on land without the right authorisation is an offence.

What the law says

Fly-tipping is the illegal deposit of waste on land without a licence, under section 33 of the Environmental Protection Act 1990. It does not matter whether the waste is biodegradable. It does not matter whether you think no one owns the land. Tipping your garden waste anywhere other than a permitted site, or handing it to someone who does, is an offence.

The penalties

• Fixed penalty notice - £500 (since 1 January 2024)
• Court fine on summary conviction - up to £40,000
• Court fine on indictment - unlimited
• Plus liability for the clean-up costs

1. Home compost what you can
2. Use your council brown or garden waste bin or subscription service
3. Take it to your local recycling centre green waste skip
4. Book a SEPA registered carrier for larger clearances
5. Never leave it on land that is not a permitted disposal site
